Bombay High Court Serves Notice To Google About Orkut Community

Based on a Public Interest Litigation (PIL), the Bombay High Court has directed the Maharasthra Government to issue a notice to Google about spreading hatred against India reports Business Standard. The issue is with the profile pic of a community on Orkut called -€œWe hate India-€ (screencap) that features an Indian flag being burnt. The PIL was filed by Advocate Yugant R Marlapalle.
Now, there are other anti-India communities on Orkut, but these don’t feature an Indian flag. It is possible to flag a community as objectionable, and there are communities against the anti-India communities too (screencap). One such community was deleted after being flagged, so one wonders why Advocate Yugant R Marlapalle chose to file a PIL against Google, instead of flagging it as objectionable.
From Orkut’s Terms and Conditions:

We may, but shall have no obligation to, remove Materials that we determine in our sole discretion are unlawful, fraudulent, threatening, libelous, defamatory, obscene or otherwise objectionable, or infringes or violates any party’s intellectual property or other proprietary rights or these Terms of Service.

It will be interesting to see how Google responds, and this would set a precedent for social networking communities in India.
