T-Series Sues Google For Copyright Violation

Update (May 10): Wasn’t a lawsuit. Just a legal notice regarding the presence of copyrighted content. details here.

Business Standard reports that T-Series has filed a lawsuit against Google in the Delhi High Court, alleging losses to the tune of Rs. 100 crore due to copyright violation. Quoting “sources close to the development” the story alleges that video clips and movies uploaded on YouTube were being used by distributors for making illegal copies for domestic consumption. It quotes T-Series President (Public Performance Licence) M M Satish as expressing disappointment about copyrighted content on the site, but there seems to be no official confirmation of the news. We’ve contacted T-Series for an official statement on the issue and are awaiting a response.

Update: Sure enough, here are clips from the movie Don, Salaam-e-Ishq and Nishabd. There are many other means of online distribution - why would anyone upload (max) 10 minute clips on YouTube? Google Video, however, still does have full movies. Here’s a camera print of nishabd. We’d reported on full movies being available on Google Video earlier…

    Not that anyone will hear as this forum is no dead - but Prasath I disagree with you. I am of Indian descent born in the USA and I got best of both worlds and don't have much bias towards one way. But music from India is peerless - India has a long tradition of musical geniuses - god blessed singers like Mohammed Rafi, Lata Mangeshkar, Kishore Kumar ; music directors that are not musicians but magicians: Madan Mohan, Shankar Jaikishan, SD Burman, Roshan, etc. A small fraction of tunes may have been inspired yes I'll admit. Rafi's voice was an inimitable original.

    i am law student and i have a answer to one of ur questions, there are international societies where a copyrighted content of a company not existing in INDIA, can sue for damages being incurred due to an INDIAN company for alleged use of that copyrighted content…...

    also, i would like to ask you, that in your initial comment on the above article, you said that "T series seems to have forgotten that they were themselves wholeheartedly “REMIXING” music that belonged to other copyright owners..HAHAH!". do you have any proof to such contention, any legal content or citation or something to support your contention/comment.

    hey Prasath, So - the existance of copyrighted stuff on a site like youtube is not ok. Is it copright holder's headache that they keep a track of such uploads? Imagine in an offline world a music company keeping track of all shops where there is a pirated copy being sold, If the right holder finds out and then notifies, the shop owner removes it!!! otherwise the fun can continue. The storage of any pirated stuff in itself is crime, is it not, so here a store is replaced with a digital space, so holding such stuff in a digital space itself is illegal. Can the shopowner caught for selling pirated music give a plea that he did not know that the stuff he is storing in his premises is pirated and get away by saying he is removing it from his premises? No he is penalised for storing it too. Similarly any digital entity storing any material which is some one else's copyright an feign ignorance and get away. They will have to stop the stuff from being uploaded in the first place. There is not other way.

  • deepender , In an international site., where millions upload their video, How do you expect to have a strict control?., Unless otherwise notified, there is almost no way to control pirated copies from being uploaded,
    If the site does not remove the pirated copy immediately after being notified, Then there is a reason to file a case.,

    Prasath, How can some one else's IPR be used on a platform controlled by Youtube, irrespective of who so ever is uploading it? Not only is there a violation of the copyright, but, its then being used for commercial purpose, like an ad copy being supered on the video. Can you imagine a similar situation in offline media lets say One tv station allowing free upload of video, as users video, and then one of the viwere choses to upload a top rated show from rival channel? Will the channel allowing upload not be responsible for IPR violation? The policy adopted by video sharing sites - unless notified of a IPR violation the stuff remains up, will have to change to - no copyrighted stuff gets uploaded, there needs to be a strict control, thats the only way.

  • Most indian musicians, copy music from foreign artists., Youtube , only can delete uploaded copyrighted music, They dont have any liability to prevent it from being uploaded.,

    Most of the music on the T Series label are rip-offs of music from international artists. Does that mean the intenational artists or their music label can sue T-Series for selling this 'inspired music'?
    I hope they do, after all, T-Series raked up the copyright violation issue.
